Terms and Conditions
1. Acceptance of terms
By accessing or using the website at www.johnbuysbayareahouses.com (the “Site”), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use this Site. These terms apply to all visitors, users, and others who access or use the Site.
2. Nature of services
John Buys Bay Area Houses is a real estate investment company, not a licensed real estate brokerage. We purchase properties directly from homeowners in San Francisco Bay Area and surrounding San Francisco County communities. We are not acting as your real estate agent or broker, and we are not providing real estate brokerage services.
Nothing on this Site constitutes a binding offer to purchase any property. Any offer to purchase will be made in a separate written agreement signed by both parties.
3. California-specific disclosures
California law provides important protections for homeowners in distress. If your home is in foreclosure or at risk of foreclosure, you have specific rights under the California Homeowner Bill of Rights (Civil Code §§ 2923.4–2923.7) and the Distressed Home Seller Protection Act.
John Buys Bay Area Houses is not a licensed real estate broker or agent. We are a real estate investor purchasing properties directly. You are not required to sell to us, and you are encouraged to seek independent legal and financial advice before entering any agreement.
Under California Civil Code § 1695, you have the right to cancel any contract for the sale of your residence in foreclosure within five (5) business days after signing. This right cannot be waived. Any agreement we enter will include this statutory cancellation notice.
We are required to disclose that we may resell your property at a profit. The purchase price we offer may be below market value. You are entitled to know the fair market value of your property and are encouraged to obtain an independent appraisal.
If your property is subject to a Notice of Default or Notice of Trustee’s Sale, California’s equity purchase regulations (Civil Code § 1695 et seq.) apply. We comply fully with all requirements of that statute.
4. No obligation
Submitting your property information through this Site does not obligate you to sell your property to John Buys Bay Area Houses, nor does it obligate us to make an offer. You are free to accept or reject any offer we make. We strongly encourage you to consult with an independent licensed real estate attorney in CA before entering into any transaction.
5. Accuracy of information
You agree to provide accurate, current, and complete information about your property. We rely on the information you provide when assessing and making offers. Any offer is subject to verification of the information provided and an in-person inspection of the property. Material misrepresentations may result in withdrawal of any offer or adjustment of purchase price.
6. Privacy & contact consent
By submitting your contact information through this Site, you consent to being contacted by John Buys Bay Area Houses and its authorized representatives by phone, email, and/or text message in connection with your property inquiry.
